Terms and Conditions
The following is a contractual agreement between the business and/or individual whom accepts the terms and conditions set forth by Barter Buff LLC and whom seeks membership and use of all services rendered through and by the company Barter Buff LLC.
Potential applicant seeking membership to Barter Buff LLC is hereafter known as the client for purposes of this agreement.
Barter Buff LLC is hereafter known as the company for purposes of this agreement. By accepting this agreement the client contracts and agrees to all of the terms and conditions in this documented agreement.
All sites and services expressly provided by the company are the property and ownership of Barter Buff LLC and therefore all powers, authorities rights pertaining to the company are therefore the property of the company. Furthermore the client acknowledges that he/she unduly understands and acknowledges all terms and conditions of this agreement and all other rules and regulations of the company and accepts the responsibility to know and understand any and all such terms, conditions, rules, and regulations and obligations set forth by the company.
Rules and Regulations
1.) Site and Property Misuse or Abuse
1.A.) Abuse or misuse of site can result in immediate dismissal of clients membership without prior notice by company.
1.B.) Client will receive written determination for dismissal within 30 days of termination.
1.C.) In this instance all Barter Buff Currency credits earned by client are deemed forfeit to the company by client. No compensation or otherwise is provided required by the company to client.
1.D.)Client is obligated and required to pay in U.S. Currency via credit card for purchases made from other company members using initially borrowed credits obtained when entering company membership within 30 days of written departure from company.
1.D.1.) Any payments and obligations not returned by client before or on the 30 day deadline are subject to a 12% charge per day for item accrual.
2.) Voluntary separation by client
2.A.) Client agrees to submit to the company a written statement of intent to separate from the company 30 days prior to date of desired separation.
2.B.)Should client voluntarily choose to separate from the company the clients forfeits all Barter Exchange Currency Credits earned and no compensation or otherwise is provided or required by the company.
2.C.) Client is obligated and required to pay in U.S. Currency via credit card for purchases made from other company members using initially borrowed credits obtained when entering company membership within 30 days of written departure from company.
3.) Fee and/or Due Payment
3.A.) It is the responsibility of the client to ensure that the company has a current, active and accurate credit card on file with the company at all times.
3.B.) Any and all mistakes or miscalculations are the responsibility and obligation of the client.
3.C.)All fees and dues not received by due dates are subject to a 3% late fee per day.
3.D.)Client gives expressed permission for automatic withdrawal from credit card account on the due dates of all fees and charges.
4.) New Membership Fee
4.A.) A New Membership fee is assessed on the date that the client joins the company to be paid in U.S. Currency.
4.B.) New Membership fee is due the day of Membership application acceptance by Barter Buff LLC.
4.B.1.) Automatic Membership occurs on the date of original membership start date.
4.B.2.) Any cancellation of membership fee charge is pending compliance of client to condition of regulation 2. of this document.
4.B.3.) Any failure to receive payment on set date of renewal is subject to late fees set forth in regulation 3. of this agreement.
4.C.) All fee amounts and dues are listed on the rate sheet. Rate sheet can change without notice. It is the responsibility of the client to periodically check rate sheet available on the company website.
5.) Monthly Fees
5.A.) Fees are due on the tenth (10th) day of each month
5.B.) All sales transaction and/or other fees made by the client are automatically deducted for clients credit card account.
6.) Transaction Fees
6.A.) A transaction fee is assessed for each sales transaction made by the seller for the total of the sale in Barter Exchange Currency (BEC credits) or U.S. Dollar or combination of both. Fees are as follows
6.A.1.) A percentage (%) fee of the total sale in U.S. Dollars.
6.A.2.) An additional fate rate which will depend on the amount of sale.
6.B.) All fee amounts and dues are listed on the rate sheet. Rate sheet can change without notice. It is the responsibility of the client to periodically check rate sheet available on the company website.
7.) Seller Rating
7.A.) Clients are to provide a Seller rating of service and/or product received for seller to buyer.
8.) Client/Client disputes
8.A.) All sales are between seller and buyer, disputes are to be handled between clients.
8.B.) The company can provide solutions to disputes, but has no obligation and the company is not responsible or obligated to any damages of product or service that might occur through transaction.
8.C.) Should the company decide to intervene in a dispute it is at the discretion and choice of the company.
9.) Company
9.A.) Company reserves the right to screen the content, materials, services and products of the clients.
9.B.) Should the company find that the material is not appropriate or consistent with views of the company, the company maintains the right to cancel the clients membership at any time.
10.) Client loss or damage
10.A.) The company is not liable for any loss or damage that may result from a transaction of any kind. The client understands that they are responsible for use of the site and must bear all losses or damages that may occur.
11.) General Policies, Procedures, And Conditions
1- All goods and services are to be sold for your regular price, at full trade. No part cash transactions will be approved for transactions under $2000.00.
2- Hotel reservations must be requested using the hotel accommodation form. Phone requests will not be accepted. There is no additional charge for this service if the form is submitted 10 days prior to check-in date for local and 14 days for out of town reservations. Reservations are non-cancelable once confirmed. There is a $50.00 cash fee for reservations requested with less than 10 days notice if confirmations are given.
3- Accounts more than 90 days in arrears on fees due will be terminated and all barter dollars in the account will become the property of Barter Buff LLC to satisfy cash fees due.
4- Accounts with fees due more than 30 days will incur a past due fee of $15.00 cash and all purchases will be suspended until fees are current.
5- Statements are sent out via email the first day of each month for the previous months activity.
6- A list of current available client services is available on our web site at http://www.barterbuff.com. If you do not have access to the web site a list will be sent out to you on request.
7- Any script requested by a client, which has to be mailed by Barter Buff LLC will be mailed 1st class mail and the client is responsible for the scrip once it is mailed. If the member requests mailing by another means, Fedex, Airborne, or any other overnight service the customer must supply their account number for billing purposes. If you request shipping by priority mail or certified mail the cost in cash will be billed to your cash due account.
8- Any account with a negative barter balance will be charged a fee equal to .833% of that balance each month, in barter. (10% per annum)
9- Disputes between members will be settled by Barter Buff LLC only if members involved agree to the decision of Barter Buff LLC being binding on all parties involved.
10- All information contained on the Barter Buff LLC website is intended for member use only. Giving access to this information to any third party will subject your account to being immediately terminated.
11- All trandsactions are at 100% retail requirements to the other members of Barter Buff LLC. No member will list products or services using the Barter Buff LLC network or website that do not allow for at least 100% of trade or barter. This includes such organizations as Multi-Level-Marketing (MLM's).
12- All members agree to restrict and desolve all other memberships with all other echanges, barter companies or trade bancs' to begin immediately becoming members of Barter Buff LLC.
