Barter Buff Trade Banc Membership Agreement
Note: Use of our Trading System & Website constitutes acceptance of membership agreement.
I/We (name of applicant) hereafter-called “Member”________________________________________________________ hereby apply for the privilege of trading goods and services with other Members of the Barter Buff, LLC. Barter Buff, LLC owns and manages the Barter Buff, LLC, hereafter called the “Trade Banc”. Barter Buff, LLC is a third party record keeper that is required by law to report Trade Banc transactions via a IRS Form 1099B at year end.
Member agrees to:
1. Offer our products and/or services for Trade Banc Trade Dollars at the regular, prevailing cash price to other members of the Trade Banc in good standing.
2. Pay an initial enrollment charge of $100. Monthly Trade Dollar fee of T$5 (Trade dollars- not cash) will be deducted from Members' account on the first of each month. Members agree to pay the Trade Banc a cash transaction fee of 5%, based on the gross value of each purchase and sale from and to other Members. This payment is made via a valid debit/credit card.
3. Members are prohibited from soliciting members of the Trade Banc for the purpose of participating in competing trading/bartering organizations while members of the association and for a period of 1 year after their membership in the Trade Banc terminates.
4. Members agree to not engage in trade or barter with other Trade Banc members outside the Trade Banc trade structure. Members that violate this provision agree to pay 10% of the purchase and sale due the Trade Banc, members are subject to have their membership terminated and positive trade balances forfeited for engaging in such transactions.
5. Abide by Barter Buff Trade Banc Rules below (and all Trade Banc policies as posted on Association web site):
5A. All purchases are to be paid through the Trade Banc. Each Member shall furnish all material and labor for 100% Trade Dollars unless pre-approved by Barter Buff Trade Banc..
5B. Members may obtain approval numbers prior to sales over $200, by calling 1-801-815-3580.
5C. Sales shall register in members' account upon transaction properly posted into our Web Site (www.barterbuff.com) or when telephoned to their Broker or the Barter Buff Office.
5D. Purchases by Members will be limited to the amount of Trade Dollars accrued to their accounts unless an appropriate Credit Line has been established by the Trade Banc. Member grants permission for Barter Buff Trade Banc to perform a background check prior to granting line of credit.
5E. Members or the Trade Banc may invoke "On Hold" status except when the Members' account is in deficit. The Trade Banc reserves the right to place members "On Hold" if they accumulate too many trade dollars.
5F. Trade Dollars may not be converted to cash.
5G. Memberships may not be transferred or sold without the Trade Banc’s approval.
5H. Members earn T$50 to T200 in Trade Dollars for new Members sponsored or referred.
5I. Trade transactions are entered into on a voluntary basis. The Trade Banc is not responsible for quality, timely delivery, timely payment, warranties or other problems that arise with respect to goods and services traded by Members or Trade Banc. Members with continuing problems in these areas are subject to review and possible termination by the Trade Banc. Members agree to indemnify the Trade Banc and Barter Buff, LLC against any claims regarding goods and services traded in the Trade Banc.
5J. The declaration, reporting and payment of all local, county, state and federal taxes and /or fees resulting from trade transactions rest solely with Member. Member indemnifies the Trade Banc against any claims made regarding the non-payment of taxes by member.
5K. The Trade Banc is authorized to suspend all trading of Members whose transaction fees are delinquent until the account is current.
5L. Member or Trade Banc may cancel this agreement at any time after a 7 day written notice for any reason. Any outstanding balance due the Trade Banc must be paid in full within 30 days, either in goods and services acceptable to the Trade Banc or in cash. In the event this obligation is referred to an attorney for collection, Member agrees to pay all reasonable attorney fees, costs and court costs and interest charges, at the maximum rate allowed by law. Member personally guarantees payment of cash transaction fees and re-payment of trade dollars owned the Trade Banc. Member has 60 days after account termination to spend accumulated trade dollars (cash transaction fees are due in advance on all transactions)
In the event of a dispute between the Trade Banc and Member resulting in a judgment entered on behalf of the Member against the Trade Banc, Member agrees that the Trade Banc shall have the right to satisfy said judgment in Trade Dollars. Barter Buff Trade Banc Trade Dollars are not exchangeable for cash in U.S. Dollars or any other currency.
